Terms of Sale for the High Performance Coaching Day Event

This contract sets out:

  • your legal rights and responsibilities;

  • our legal rights and responsibilities; and

  •  certain key information required by law.

In this contract:

  • ‘We’, ‘us’ or ‘our’ means High Performance Life Limited.

  • ‘You’ or ‘your’ means the person buying the tickets to the event from us.

  • ‘Event’ means the High Performance Coaching Day Event.

1.              THESE TERMS

1.1           When you register for our event, these are the terms and conditions which apply. If you are booking on behalf of another person who is over 16, you confirm that you are authorised by that person to make the booking, and that the person has confirmed their agreement to be bound by these terms and conditions. You acknowledge and agree that both you and the person for whom you are making the booking will be bound by these terms and conditions.

 

1.2           Please read these terms carefully before you register for our event. These terms tell you who we are, how we will provide the event to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss. We recommend you save a copy of them for your future reference.

 

2.              INFORMATION ABOUT US AND HOW TO CONTACT US

2.1           We are High Performance Life Limited, a company registered in England and Wales under company number 13239985. Our registered address is Jonathan Scott Hall, Thorpe Road, Norwich Norfolk, NR1 1UH.

2.3           If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when booking your tickets.

 

3.              OUR CONTRACT WITH YOU

3.1           If you buy tickets for the event from us you agree to be legally bound by this contract. You also agree to be legally bound by our Privacy Policy and any documents referred to in it.

3.2           To apply for a place at our event, you should click ‘Book Tickets’. You will then be asked to enter your name, email address and payment details. To purchase the tickets to our event, you must click the ‘Buy Now’ button.

4.              PRICE AND PAYMENT

4.1           When booking our event full payment of the fee is required at the time we accept your booking. The price of the event (which includes VAT at checkout) will be the price indicated on the order page when you book your tickets. The price includes premium sandwiches and tea, coffee and water as set out in the description of the event on our website, but you are responsible for any other costs you incur at the event such as additional food and drink (including alcoholic drinks) that you order.

4.2           We accept the following payment methods: all major credit and debit cards (via Stripe). We do not accept cash or cheque payments. 

4.3           We will do all that we reasonably can to ensure that all of the information you give us when purchasing the tickets for the event is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy or breach by us of our duties under applicable laws we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.

4.4           All payments by credit card or debit card need to be authorised by the relevant card issuer.

4.5           The price of the digital content is in pounds sterling (£) (GBP). VAT is added at checkout.

5.              COACHING DAY EVENT

5.1           In order to get the most from our event you should ensure you arrive promptly.

5.2           We reserve the right to request that any person leaves the event if that person’s conduct is unacceptable (in our reasonable opinion). No refund of fees or any other costs will be made in these circumstances.

5.3           You will receive an email confirmation of your booking to the email address you provide to us shortly after you purchase your tickets. It is your responsibility to ensure that the email address you provide to us is valid.

5.4           All bookings are non-transferable without our consent and must not be resold or passed on for commercial gain.

 

6.              CHANGES TO OUR EVENTS

6.1           Although we make every effort to run the event as described on our website factors beyond our control may occasionally mean that we have to make changes to activities, times or venues. This may be for health and safety reasons, adverse weather, to comply with legal or best practice requirements or supplier issues. Often these will be minor changes and sometimes we may not know about them until the last minute.

6.2           If we need to make a significant change in advance of the event which might adversely affect your experience we will do our best to let you know and you will have the right to cancel the contract and receive a refund.

 

7.              YOUR RIGHTS TO END THE CONTRACT

7.1           If you cancel your event booking, or do not attend our event, the event fee will not be refunded, although you may be able to transfer your booking to another person by passing on your original ticket with our consent only.

7.2           To end the contract with us, please contact us using one of the methods set out at Clause 2.2.

 

8.              OUR RIGHTS TO END THE CONTRACT

8.1           We may cancel our event at any time prior to its commencement and we will refund you the full price of your booking. We shall not be responsible for any extra costs incurred as a result of a cancelled or rescheduled event.

8.2           If our event has to be cancelled, we will contact you as soon as possible to let you know and refund any money you have paid to us for the event. We will refund you the price you paid for the event by the method you used for payment.

 

9.              YOUR LEGAL RIGHTS

9.1           See the box below for a summary of your key legal rights in relation to events you have paid for. Nothing in these terms will affect your legal rights

 

10.           OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

10.1        Please ensure you take care of your personal possessions as we cannot accept any liability for them unless loss or damage is caused by our negligence. 

10.2        We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation or for breach of your legal rights in relation to the event as summarised at Clause 10.1.

10.3        Except as stated above in Clause 11.2, our total liability to you is limited to the fees you have actually paid for our event and we will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions.

 

11.           YOUR PRIVACY AND PERSONAL INFORMATION 

11.1         Our Privacy Policy is available at https://www.thehighperformancepodcast.com/privacy/

11.2        Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information. We will also need to process your dietary information for the event.

11.3        We may also take photographs and videos during the event as a record of the event and for future use by us to market these events. By purchasing this ticket, you consent to your inclusion in and use of such photographs and recordings. If you change your mind, please let us know as soon as possible

 

12.           RIGHTS IN MATERIALS

12.1         All copyright and other rights (including all intellectual property rights) in materials provided to you during or for the purposes of our event are the property of High Performance. You are entitled to use such materials only for your own personal use only. You are not entitled to copy such materials (except as permitted by law) nor are you entitled to use or authorise others to use such materials for any commercial purposes.

 

13.           OTHER IMPORTANT TERMS

13.1        You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

13.2        This contract is between you and us, unless you registered for an event on behalf of a family member, in which case the family member is also bound by the terms of this contract. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.

13.3        Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

13.4        If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect Terms and conditions for events - consumer of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the event, we can still require you to make the payment at a later date. 

13.5        These terms are governed by English law and you can bring legal proceedings in respect of the event in the English courts. If you live in Scotland you can bring legal proceedings in respect of the event in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the event in either the Northern Irish or the English courts.
